In our article of May 27, 2021, we reported on the planned tightening of the fixed-term employment regulations, which was originally planned to enter into force on January 1, 2022.

Although it initially appeared that a corresponding amendment to the existing law would be passed during the current legislative period and enter into force as planned on January 1, 2022, such a change to the law is off the table for the time being.

The draft bill is not on the agenda for the last session week of the Bundestag in the current legislative period. It is therefore out of the question that a bill to tighten up fixed-term employment regulations will be passed before the elections in September.

It now remains to be seen whether the new government will take up this issue again. Particularly in view of the continuing (planning) uncertainties in connection with the SARS-CoV-2 pandemic, the postponement of any tightening of the fixed-term employment regulations, especially the drastic limitation of fixed-term employment contracts without factual reason, will be of great benefit to employers.
