Matrix Managers: Participation in Works Council Elections in Multiple Establishments Is Possible
Matrix structures are part of everyday business in many companies – managers often lead their team members across divisions and locations. But how does this organizational structure affect co-determination rights? A recent decision of the Federal Labor Court (Bundesarbeitsgericht, BAG) dated May 22, 2025 (Case No. 7 ABR 28/24) provides greater clarity regarding voting eligibility in works council elections under Section 7 of the Works Constitution Act (Betriebsverfassungsgesetz – BetrVG): matrix managers can be eligible to vote in more than one establishment at the same time.
